Service Availability

We strive to keep our services available. We cannot promise uninterrupted access. We may suspend services for maintenance, updates, or other reasons beyond our control.

Account Creation

To use our services you must create an account. You must provide accurate information.

• You must provide accurate, current, and complete information.
• You must maintain and update your account information.
• You are responsible for all activity under your account.
• You must keep your login credentials secure.

Photo Upload Requirements

When you upload photos, you must ensure they meet our requirements.

• You must own the rights to uploaded photos or have permission.
• Photos must not contain inappropriate or illegal content.
• Images must be clear, well-lit, and suitable for 3D.
• Photos must not violate third-party rights or privacy.
• Content must follow our community guidelines.

Prohibited Uses

You must not misuse our services.

• You must not use the service for illegal activities.
• You must not upload copyrighted material without permission.
• You must not create figures of public figures without required consent.
• You must not harass or abuse others using our platform.
• You must not attempt to reverse-engineer our technology.
• You must not interfere with our systems or security.

Account Security

You are responsible for your account security. Notify us at support@atotoi.me if you suspect unauthorized access.

Order Process

• We confirm orders after payment is processed.
• We may refuse or cancel orders at our discretion.
• Order changes may not be possible once processing starts.
• We send email confirmations and updates during the process.

You make an order when you place an order on our site.

We accept the offer when we send a shipping confirmation email for that order.

Until we accept, we may cancel the order. We will notify you by email if we cancel.

You must provide a valid email address. We are not liable for failed delivery to an address you provide incorrectly.

Payment Terms

Shipping Policy

• Risk of loss transfers to you upon delivery to the shipping address.

We provide tracking information for most orders.

A delivery attempt may be made. Carriers may leave the parcel with a neighbour or at a safe place when permitted.

Proof of delivery from the carrier is evidence that the parcel reached the delivery address.

For international shipments, the recipient is responsible for customs duties and local taxes unless stated otherwise.

Delivery Issues

Quality Guarantee

We stand behind our work. If a figure has a manufacturing defect or fails to meet our standards, we will remake it or provide a refund.

Your Content and Photos

• You retain ownership of the photos and content you upload.
• You grant us a limited license to process photos for figure creation.
• We may use anonymized data to improve our AI.
• You may request deletion of your photos after the order completes.
• We do not claim ownership of your personal photos or likeness.

Our Intellectual Property

• Our AI technology, algorithms, and software are proprietary.
• Website content, design, and branding are protected by copyright.
• You may not reproduce, distribute, or reverse-engineer our technology.
• Generated 3D models are created using our proprietary processes.
• Ātotoi trademarks and logos are our property.

Generated 3D Models

We create 3D models from your photos for personal use. You own the physical figure we send. The underlying 3D model files remain our intellectual property unless we transfer them under a commercial license.

Copyright Infringement

If you believe we used your copyrighted work without permission, contact legal@atotoi.me with details. We will investigate and act in line with copyright law.

Limitation of Liability

Force Majeure

Arbitration Agreement

For disputes that cannot be resolved informally, you agree to binding arbitration:

• Arbitration rules of a recognised neutral arbitration body will apply (to be agreed by the parties where possible)
• Arbitration will take place in London, England, or via video conference
• You waive the right to participate in class action lawsuits
• Small claims court disputes are excluded from arbitration

Either party may seek injunctive relief in court for intellectual property violations or other matters requiring immediate legal action.

Changes to Terms

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Ātotoi regarding our services.

Assignment

We may assign these Terms or our rights and obligations without notice. You may not assign your rights or obligations without our written consent.

Waiver

Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or any other provision.
